Kurv London Ltd is committed to ensuring the highest standards of public safety, professionalism, and integrity across all areas of its operations. This policy outlines how we assess and manage applicants or existing staff who have criminal convictions.
The policy ensures fairness, transparency, and compliance with relevant Transport for London (TfL) licensing rules, including the requirement that all licensed drivers must be assessed as fit and proper.

- To ensure all assessments involving criminal convictions are carried out fairly, consistently, and transparently.
- To recognize that a past conviction does not automatically disqualify an individual from working with us or applying for a license.
- To comply with TfL standards, including mandatory DBS checks, reporting obligations, and suitability assessments.
- Disclosure and Barring Service (DBS) Checks
All driver-related roles within Kurv London Ltd require completion of an Enhanced DBS check, as mandated by TfL.
The DBS report will be used to:
- Confirm an applicant’s criminal history.
- Assess whether the individual meets TfL’s fit and proper standard.
- Evaluate any risks associated with licensing or employment within the company.
Failure to undergo or provide a valid DBS check will result in automatic disqualification from the application process.
- Case-by-Case Assessment
Kurv London Ltd does not automatically reject applicants with previous convictions.
Each application involving a conviction will be reviewed individually, considering:
- The nature and seriousness of the offense
- Whether the conviction is spent or unspent
- The time elapsed since the offense
- Any pattern of offending, or whether the incident was isolated
- Evidence of rehabilitation, personal development, or mitigating factors
- Character references or supporting documentation
- Alignment with TfL licensing expectations
The overriding consideration will always be public safety.
- Serious Offenses and Licensing Restrictions
Certain offenses significantly impact the likelihood of employment or licensing approval. Examples include:
- Crimes involving violence or aggression
- Sexual offenses of any kind
- Offenses relating to dishonesty, fraud, or deception
- Serious drug-related offenses
- Offenses involving weapons
Applicants with unspent convictions for these offense types are unlikely to be approved. Even spent convictions may require further investigation to determine suitability.
- Proof of Suitability and Rehabilitation
The applicant or driver bears full responsibility for demonstrating that they are a fit and proper person.
This may include:
- Written explanations of past offenses
- Evidence of rehabilitation, such as completion of programmers or training
- Character references from professional or community leaders
- Employment history showing reliability and responsibility
- A clean record over a meaningful period
Merely being free from convictions for a period is not guaranteed proof of suitability.
- Ongoing Reporting Obligations
All licensed drivers and employees must:
- Inform Kurv London Ltd immediately if they are arrested, charged with, or convicted of any criminal offence relevant to their role
- Notify TfL directly in accordance with TfL licensing rules
- Provide any requested supporting documentation
Failure to notify the company may result in suspension or termination of work.
- Confidentiality and Data Handling
All information regarding convictions or DBS results will be handled in strict confidence and in accordance with:
- GDPR
- Data Protection Act 2018
- Company confidentiality policies
Information will be shared only with authorized personnel involved in suitability assessments or compliance requirements.
- Decision-Making and Appeals
Kurv London Ltd’s management team will document the rationale for any decision made concerning an applicant with convictions.
Where an applicant or driver disagrees with a decision, they may submit a written appeal, including additional evidence for reconsideration. Appeals must be made within 14 days of receiving the decision.
- Policy Review
This policy will be reviewed annually, or sooner if TfL updates its licensing standards or legislation changes. Kurv London Ltd reserves the right to amend this policy at any time to maintain compliance and safety.
